Website Hosting Terms of Service and Acceptable Use Policy

Your continued use of our services indicates acceptance of these terms, conditions and policies.


If you are a hosted client of CBass Web Design:

CBass Web Design resells the hosting services of, and is legally bound to, and has adopted, the Policies thereof.   As a customer/client of CBass Web Design, You are likewise legally bound to these Policies. If you disagree with any of these Policies, you must cancel your account with CBass Web Design.

    1. These are the terms You agree to when ordering services from or continuing as a customer/client of CBass Web Design. The Agreement incorporates the following documents by reference: the plan Description that describes the services You are buying and related fees; these Terms of service (TOS); the CBass Web Design TOS (printed following the SiteGround TOS below), and the Privacy Policy. When we use the term "Agreement" or "Agreements" we are referring collectively to all of them.

    2. It is understood that the SITEGROUND.COM Terms of Service are specifically those of SITEGROUND, and that all clients/customers of CBass Web Design are legally bound to these terms.  The SITEGROUND TOS is accessible by clicking on this link: SITEGROUND TERMS OF USE.

    3. It is further understood that CBass Web Design, other than being a reseller of their hosting services, is NOT otherwise affiliated with SiteGround, and any billing, guarantee/warranty, or refund information shown in their terms at the above link may not accurately reflect the billing, guarantee/warranty or refund information applied to CBass Web Design’s hosting clients.  As web hosting clients of CBass Web Design, you must contact CBass Web Design, NOT SiteGround, for any issues.  SiteGround will not directly provide technical support or service to clients of their resellers, including CBass Web Design.

The following section Comprises CBass Web Design's specific client Terms regarding Website Design and Hosting services and fees and is to supersede similar or conflicting content in SiteGrounds's Terms of Service above.


Strong Passwords Required

 Strong passwords are required. Account Holders agree to use strong passwords and are responsible for maintaining the confidentiality of those passwords. If we discover an insecure (simple) password, we reserve the right to ask You to change it to a secure password or we may change it for You. Passwords should not contain the username, person's name, dictionary word, or keyboard combinations, AND should be 12 characters long. Such as: y7wUv82Pcr3f. It would take a script only a few seconds to crack a password such as "8571jackson." Preferably, passwords will contain a mix of lower case and uppercase letters as well as numerals. Passwords may use the following characters: Exclamation point (!), Underscore (_), Equal sign (=), Period (.), and Comma (,).

"CLEAN UP FEE: If an account has been breached because of the use of a weak password and the breach results in the account being used to send spam, should that spam result in getting our IP space black-listed You will be charged a clean up fee. Those fees start at $350.00."  That is the fee that our hosting provider charges, and we have no control over that fee.



NonWarranty: We do not guarantee that our work will be error-free and so we cannot be held liable to you or any third-party for damages, including lost profits, lost savings or other incidental, consequential or special damages, even if you’ve advised us of them.

Copyrights: By using our website design and/or hosting services, you guarantee that all elements of text, images or other artwork you provide are either owned by you or that you’ve permission to use them.  CBass Web Design cannot be held liable for your infringement of another's Copyright.


Hosting Fees

Hosting fees are charged in advance, and may be paid for monthly, quarterly, semi-annually or annually.

Web Site Update and Maintenance Fees

Unless previous arrangements have been made, fees for services are due prior to services being rendered.  Requested site updates will be performed at our standard hourly rate, with a one-half-hour minimum.  Monthly statements will be generated on or about the 15th of each month.  If you would like to establish a monthly maintenance agreement by retainer, please contact us.

Billing Cycle

The Billing Cycle begins on the fifteenth day of the month following the day services are initially ordered, and runs from the 15th of a month to the 14th of the following month.

All payment must be made in US dollars.

Late Payments

If full payment on any statement is not received on or before the 14th day of the month following the statement date, you may be charged a monthly late charge of 2.5% of the unpaid amount, with a minimum monthly charge of $5.00, or such late charge allowed under applicable law, regulation or contract.  If your account is past due, we reserve the right to perform no further updates to your website until your account is paid in full or satisfactory payment arrangements are made.  This late fee will accrue each month that your account is in arrears.

Note that we do not differentiate between hosting and other services in past due accounts; any payment received will be applied first to the past due amount and then to the current charges, regardless of whether you specify your payment to be "for hosting only" or similar.


Account Suspension for Non-Payment

If an invoice for any services associated with an account with CBass Web Design is not paid within thirty (30) days after the date of the invoice, a past due notice along with a "Notice of Impending Suspension" may be mailed out.

If no payment has been received within sixty (60) days following date of invoice, the account may be suspended and all access to your files and site will be shut off. This means that your website will not be visible on the Internet, nor will you be able to access your website via FTP.  To have your account unsuspended because of non-payment, a twenty five dollar ($25.00) service charge will apply in addition to the full amount past due.

Unless you contact us and request payment arrangements, we must assume that if an account has been allowed to become over ninety (90) days late, it is the customer's intent to discontinue utilizing our services and terminate the account. Accounts that remain unpaid for ninety (90) days following date of invoice are subject to removal from the server. To have your site reloaded onto the server after being removed for nonpayment, a non refundable one hundred fifty US dollar ($150.00) reactivation fee must be received in addition to the full amount previously due.

If your non-payment results in termination, your data will be deleted and no longer retrievable. CBass Web Design is under no obligation to make, or provide you with, a backup copy of your data prior to deletion.  You hereby acknowledge that this is CBass Web Design's policy when it comes to data retention, and waive all rights in and to your data in these situations.

In the event that a client has been allowed to accumulate a debt beyond the due date of a payment and the client then makes a partial payment on any outstanding amount, such payment will be offset against the largest and/or oldest amount outstanding.

Uncollected past due accounts are subject to submission to a third-party collection agency. Client shall be liable for all fees associated with such collection actions. Accounts which have been placed with collections will be subject to the late payment fee as described above.  While CBass Web Design does not report accounts to credit agencies, accounts submitted to a collection agency may have a detrimental effect on client's credit rating.

In the case of a disputed charge on an invoice, Client shall pay the undisputed amount and provide a letter of dispute describing why they feel the total amount billed is in error. We will investigate and may amend the disputed invoice if such action appears to be warranted.  Please contact us if you have any question regarding any bill, invoice or statement you receive from us.

CBass Web Design is not liable for any loss of profits, projected profits, or the loss of any other monetary or non-monetary benefits resulting from the use or termination of an account.

There is a twenty-five US dollar ($25) service charge for returned checks or credit card charge backs.

It is not our desire to put any of our clients out of business. If you are experiencing an unusual hardship and are finding it difficult to pay your amount due in full, please call for arrangements to avoid suspension/removal of your account. However, no leniency that we may show in terms of any of the above at any time, will in any way and under any circumstances constitute a waiver of any of our rights to enforce any and all of our terms and conditions at any time in the future.

Domain Name services

CBass Web Design is a reseller of Enom's and NameSilo's domain registration services.  If You use our Domain Name services to register, renew or transfer a domain name, you agree that CBass Web Design's sole responsibility is to submit the request to Enom or NameSilo (the "Registrar"). CBass Web Design is not responsible for any errors, omissions or failures of the Registrar. You are solely responsible for the costs of the Domain Name services. All Domain Name services sales are final and are exempt from any Money Back Guarantee. Your use of domain name services is subject to the applicable legal terms of the Registrar posted on their website. You are responsible for managing your domain(s), closing any account with any prior reseller of or registrar for the requested domain name, and you are responsible for responding to any inquiries sent to you by the Registrar. 

Renewal notices and other email notices may be generated and sent to you automatically by Enom or NameSilo.  These notices will appear to come from "Domain Guru" or "CBass Web Design."  They are legitimate notices.  If you have any concerns or questions regarding any email notice you have received, please contact us.

Please note that domain name registration made through CBass Web Design will NOT automatically renew at the end of each registration period. If we have registered your domain name, or transferred your domain name to our registrar, we will attempt to notify you by E-mail at least thirty (30) days prior to the end of your registration period that your domain name is due to expire (see preceding paragraph).  Nevertheless, it is Your responsibility to know when your domain name is due to expire, and CBass Web Design is not responsible for domain name registrations which have been allowed to lapse.

To check on the expiration date of your domain name, visit, or and input your domain name. While there, please review the contact information listed for your domain name. If it is incorrect, please notify us or whoever registered your domain name.

Please be aware that if your domain name expires, all email, website, or other services that were associated with it will be affected. Additionally, if your domain is not renewed prior to the expiration date, it will go into a “Redemption Period” during which the registrar may charge up to two hundred fifty dollars ($250.00) to reactivate the domain. CBass Web Design has no control over this fee. After being in the Redemption Period, which lasts from 60 to 90 days, un-renewed domain names are returned to the open market and are subject to registration by other parties.

If you have registered your Domain Name through any registrar independent of CBass Web Design, it is not our responsibility to notify you of pending expiration dates.  This is because unless you have named us as billing contact on that account, we will receive no notification that the domain is pending expiration.

Keeping track of Your domain's expiration date is wholly Your responsibility and CBass Web Development will not be held liable for any downtime and/or resulting loss of income resulting from the expiration of Your domain name.

Reservation of Rights

CBass Web Design reserves the right at all times to require changes, disable as necessary any website, account, database, or other component that does not comply with its established policies, or to make any such modifications in an emergency, without notice if necessary. We also reserve the right to prohibit activities that damage CBass Web Design's commercial reputation and goodwill. Any material that, in our judgment, is obscene or threatening or otherwise violates our agreements is prohibited. CBass Web Design will be the sole arbiters as to what constitutes a violation of this Policy.


Privacy Policy

This Privacy Policy is incorporated by reference in the Terms of Service. Terms used in this Privacy Policy shall have the same meaning given in the Terms of Service.


During your visit to, we will not collect personal information from you unless you provide it. If you do nothing during your visit but browse through the website, read pages, or download information, our Web statistics program will gather and store certain information about your visit automatically. This information does not identify you personally. We automatically collect and store the following information about your visit for statistical purposes:

  • Internet domain (for example or and IP address (the number automatically assigned to your computer when you are surfing the web) from which you access our site
  • The type of browser and operating system used to access our site
  • The date and time you access our site
  • The pages you visit
  • The address of the page you used to link to our site, if any

We collect this information to measure the number of visitors to the different sections of our site and to make our site more useful to visitors.

You may choose to submit personal information to our website either through email or forms. This information is accessed by the Webmaster and/or technical staff in order to reply or respond to your email or inquiry and may be retained either in electronic or paper format.

E-mail is NOT secure against interception. Your information, including your e-mail address, is for our records only and will assist us in helping you. Your information, including your e-mail address, will remain strictly confidential and is not sold, leased or given to any other party.


CBass Web Design Customer Privacy Policy


When you sign up for our service, we will ask you to provide contact information such as your name, address, telephone number(s) and email address(es).

If you contact us for customer support, we may also ask you for information about your account username, software and other information necessary to solve your issue.

If you contact us with sales questions, we may ask you for information about your hosting needs and previous experiences regarding web site hosting in order to better answer your questions.

When you visit our web site(s) we will capture your IP Address, time of and duration of visit, and time and duration of the pages on our web site(s) that you view. We may tie this information to the personally identifiable information we have about you.

We may also place a cookie that will identify you to us as a repeat visitor or a customer when you visit our web site(s). See "What is a Cookie?" below. We may tie this cookie to the personally identifiable information we have about you.


Use of Personally Identifiable Information

We will use your personally identifiable information only as follows:

  • for payment processing
  • to conduct a fraud check when you purchase a service
  • to provide customer support
  • to announce important information regarding our services or changes to our services
  • to notify you regarding your account or changes to your account; or
  • to improve our service and the marketing of our service. For example, we may use the information we gather from user surveys, demographic data, and web site visits to help us improve or target our web site(s) and customize your visit.

We will not provide any personally identifiable information about you, or disclose the content of the electronic data you store on our system, to any other person, other than to:

  • a law enforcement or regulatory agency at their proper legal request or if your electronic data is found to contain illegal content;

We absolutely do not transfer or sell your information for inclusion on third party email or other marketing lists.


Use of Non-Personally Identifiable Information

We will not share aggregate statistical data about our customers with third parties, such as advertisers or suppliers.

Security of Your Information

We may store sensitive information securely encrypted in our databases. Additionally, sensitive information may be stored securely with our payment gateways: Flint and PayPal. We always use industry-standard encryption technologies when transferring and receiving consumer data exchanged with our site.

Children's Privacy

Our service is not directed towards children and is not available to children under the age of 13. We will not intentionally collect or maintain information about any person under the age of 13.

What is a Cookie?

A "cookie" is an alphanumeric identifier that is unique to your browser. The cookie will identify your browser to us when you visit our web site so that we may customize your visit.
